BNP Paribas, the largest bank in the Eurozone, faced the complex challenge of implementing new IR35 legislation. The bank needed a compliant solution for engaging contractors that limited tax liability risk and did not disadvantage them in the competition for talent. They consulted with their Managed Service Provider, AMS, to understand the best way to manage this change and mitigate the risks of performing incorrect individual IR35 assessments.
AMS implemented a solution where BNP Paribas would only engage contractors via FCSA registered umbrella companies, eliminating the need for individual status assessments. AMS managed the entire transition, communicating with and successfully migrating approximately 650 contractors to the new arrangement with little disruption. As a result, the project was completed ahead of schedule and HMRC subsequently confirmed it was happy with the bank's approach, finding the risk of operating the rules incorrectly to be low.
