How Sawayo avoided a hefty fine

Calor Systems Ltd., a small Berlin-based housing services company, faced a significant legal and financial challenge. An employee who resigned subsequently filed a lawsuit claiming over 200 hours of unpaid overtime. Due to a recent European Court of Justice ruling, the burden of proof for accurate time tracking fell on the employer, and the company lacked a proper system to refute the claim, risking a hefty fine.

The vendor Sawayo provided its time tracking software, which the company had implemented just prior to the court hearing. Although the employee in question had not used it, the judge saw Sawayo’s implementation as a demonstration of good faith and a move towards compliance. As a result, the court ruled in favor of Calor Systems, saving them from having to pay the €5,000 overtime claim and avoiding a potential fine.
